Acceptable Uses Policy
By entering into an agreement for Services with Us You agree to be bound by this TOS as may be amended from time to time.
This Acceptable Use Policy specifies certain actions prohibited by AztecOne for users of the AztecOne Network. AztecOne reserves the right to modify this Policy at any time to stay in compliance with any laws, regulations and security requirements. By using AztecOne services, any customer, employee or third party unconditionally accepts the terms of this policy.
Hosting Only
These hosting accounts are for web hosting and email only. NO IRC server, IRC bot or game servers are permitted. Any site not in compliance will be canceled and any fees paid forfeited.
ILLEGAL USE.
The AztecOne Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation coming to or from any unauthorized network or system is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property rights used without proper authorization; government and military data protected by law and national security; university and academic data protected by public policy; and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Any violation of the above which compromises the integrity of the AztecOne Network or any other network is strictly prohibited.
SYSTEM AND NETWORK SECURITY
Violations of system or network security are prohibited, and may result in criminal and civil liability. AztecOne will investigate incidents involving such violations and may involve and cooperate with law enforcement authorities if a criminal violation is suspected. Examples of unlawful acts, system, or network security violations include, without limitation, the following:
Unauthorized access to or use of data, systems or networks, including any attempt to probe, damage, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network. Interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks.
Unauthorized access to any data, system, or network from an unauthorized system or network for any purpose which is not lawful or which is intended to do harm.
Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting. Electronic forging of any kind to include but not limited to IP addresses, domains, business names, etc.
MISUSE OF ACCOUNT
Operating any service which makes an account feature available to third parties for any use other than normal access to that account's Web site is forbidden. Operating any service which enables or assists anonymous or abusive behavior by third parties is forbidden. Operating any service which affects the stability or reliability of any network server or network component, impacts other users or the company negatively, or degrades quality of service is forbidden.
This includes but is not limited to third party access to CGI services, database hosting, counters, banner exchanges, autoresponders, mailboxes, mail forwarding, mail filtering, and content publishing systems. All account features are to be used solely in order to develop and implement the Web site(s) associated with that account. Resellers may make reasonable use of account features shared between multiple accounts they are being billed for.
This means that, for example, you cannot:
resell autoresponders to third parties
run a service like hotmail.com
run a service like pobox.com
run a service like tripod.com
run a service like linkexchange.com
run a service like thecounter.com
run CGI scripts for other sites
run a public blog for multiple users
host a remailer
RESOURCES
Users may not, through a cron job, CGI script, interactive commands, or any other means, take the following actions:
- Run any program that requires more than 30 CPU seconds to complete.

Run any program that "fork bombs" or otherwise uses child processes in a manner that disrupts performance of the server, or in order to attempt to circumvent resource restrictions.

Use the find command, or any similar tool which recursively explores directory structures, anywhere except in their own directories.

Send out mail to more than 100 addresses in one batch, whether sequentially or in parallel. Such batches must "sleep" for at least three seconds between each delivery attempt. Please consider using a service for such mailings.
- Send prohibitively large messages to any receiving system that cannot or does not wish to receive them. Large file transfers should be accomplished through FTP, not electronic mail.

Run their own mailing list software, whether custom or packaged.

Run any interactive chat application.
- Run a banner exchange, remotely-accessible Web counter, or any other service that performs CGI services for sites outside our network. Please see the policy on misuse of account features.
EMAIL and ABUSE of SERVICES
Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site owner.
The transmission of unsolicited or prohibited advertising or other content through electronic mail or inappropriate Usenet postings is forbidden. The use of our network for unsolicited mass mailings or postings (commonly known as "Spam") by any customer will cause that customer's services to be terminated immediately and without warning, and the customer will be held legally responsible for the damages to Aztecone, both monetary and in reputation. The use of any other service to make such a mailing or posting, with any reference to our network (including but not limited to mailboxes, autoresponders, and Web pages), shall also be grounds for account termination and/or other actions as described above.
Abusive behavior can severely damage your online reputation and business. We will not tolerate such incidents.
USENET
Posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting) especially with the intent of promoting your site, services, products etc. This behavior, also known as "SPAM", is expressly prohibited.
INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF AN AztecOne CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.
For Example:
If you are hosting a bulk email site on AztecOne servers and you use another ISP to SPAM from in order to reference your AztecOne site by IP address or domain name, you are violating AztecOne policy and possibly the law.
If you have been granted telnet access to AztecOne servers, multiple telnet log-ons are strictly prohibited and you must come from a valid IP address. Forgery is against the law.
Any type of denial of service attack from valid or invalid addresses is a violation of AztecOne security policy and against the law.
If you have been granted password privileges for FTP or telnet, sharing your password with an unauthorized user or third party is strictly prohibited.

The Digital Millennium Copyright Act provides limitations for service provider liability relating to material online with regard to information residing, at the discretion of the user, on a system or network that the service provider controls or operates. 17. NO ADULT OR X- RATED SITES
AztecOne will also not tolerate any adult material or spamming and both infringements shall result in immediate termination and removal of the site and/or virtual server without a refund. AztecOne prides itself as a responsible member of the Internet community and is committed to protecting the data of and providing quality service to all AztecOne customers all of the time.
HATE
AztecOne will not tolerate hate material on our servers and shall cancel without notice any site the incites or has intent to incite general hatred of any ethnic or other group. We reserve the right to decide if a site violates our hate clause.
CANCELING YOUR ACCOUNT
You must notify us via EMAIL from your web hosting account if you wish to cancel your account. Accounts canceled will receive a refund only for FULL months or quarters (depending on the type of account) remaining that have been pre-paid less any used portion at regular price. Refunds will be made in the same form as the original payment.
BREACH AND REVOCATION:
In the event that AztecOne may at any time believe that the Service is being utilized for unlawful purposes by the Customer or in contravention with the terms and provisions herewith, AztecOne may unilaterally and immediately discontinue such Service to the Customer without liability. This will include failure to pay, adult content and/or unsolicited email.
PAYMENT OF HOSTING FEES
The set-up fee and first payment are due at the time
the application is filled out, and returned to AztecOne. Subsequent payments
are due according to the selected fee schedule following the establishment
of the web space on the Internet. Web space will be billed a minimum of
one (1) month in advance depending on the selected fee schedule. Subsequent
payments are due on the 1st day of each month as per the selected fee schedule.
In the event that the Customer fails to pay for such services in advance,
AztecOne shall be entitled to unilaterally terminate this Agreement and discontinue
the service until payment is made.
Charges are usually run on the last Friday of each month or within the last 5 days of the month for the following month.
INTERACTION WITH AztecOne STAFF.
Any threat, vulgar language or harassment directed at any AztecOne staff member through phone or email may result in immediate termination of an account. Any violation of this policy by any employee, contractor or third party programmer of AztecOne should be reported immediately.
At Our sole discretion we may change the details of the TOS from time to time. It is your responsibility to check for updates to the TOS occasionally..
